Police are investigating after a motorist taking a call on his phone was involved in a near miss with a cyclist in the capital.
The incident happened on Earl Grey Street, Edinburgh at around 7.50am on Thursday February 23rd.
Sam Whyte, a Media Manager was on his daily commute when the driver swerved into his path as the segregated cycle lane joined the main carriageway – he managed to avoid a collision by cycling around the vehicle.
It then becomes clear that the driver was distracted because he is on a call holding the phone up to his mouth.
The unknown driver of the JK Contracts vehicle apologised if he cut someone up when contacted by SWD Media.

“I apologise if I cut someone up, I could not stop in that area to park my vehicle to answer my phone, it was a personal call and I wouldn’t normally do that.”
Speaking today Sam, 35 said: “Every day road users are subjected to abuse or issues and this is true for cyclists, pedestrians, drivers… everyone.
“Too often we see that the only way we can ensure reckless behaviour is ruled is if we hold up a mirror to those who do wrong – whether that be on social media, in the news or in the courts.
“I really hope this guy learns his lesson because it’s never okay to be on the phone behind the wheel.

“It also shows why it’s so important to dress bright, wear your helmet and even have a camera if you can because without protecting and deterring the most vulnerable road users will continue to suffer.”
Transport and Environmental Convener, Councillor Scott Arthur has confirmed that plans to re-design Lothian Road/Earl Grey Street are well underway as part of the city centre transformation project.
Latest designs show increased pedestrian space, one lane traffic in each direction with segregated cycle lanes, however there are no plans to restrict traffic as it is a key route for goods and services traffic.
Councillor Arthur said: “Careless driving risks the safety of vulnerable road users and should be reported to the police.

“The current layout on Lothian Road allows the Tollcross junction to operate efficiently, however medium term we will be redesigning Lothian Road as part of City Centre Transformation.”
Police Scotland said: “I can confirm police have received information about an incident in Earl Grey Street, Edinburgh regarding a cyclist and a van.
“Officers are due to speak to the man who made the report at a later stage.”
Councillors agreed Edinburgh’s City Centre Transformation, a 10-year £314 million pound project in 2019 and has been delayed due to Covid-19.
